In a Press Release on Friday, The Ministry and Department of
Labour expressed concern that "some employers are granting
permission to their employees who received work permits on
their behalf to work for other employers." The release
further stated that "additionally, it has been
reported that some work permit holders are working illegally
in a self employed capacity."
It continued:Persons carrying out such practices are
advised that they are in breach of Conditions (1) and (2) of
the work permit which authorizes the work permit holder to
work for the named employer and in the stated occupation
only, and that there be no change of employer or occupation
without the approval of the Minister of Labour.
Anyone found undertaking this illegal activity will have his
or her work permit revoked.
Likewise persons working on the island illegally are
reminded that they are in contravention of the Control of
Employment Act. According to Section 2 subsection (2 ) of
the said Act “Any Person who engages in any occupation in
Anguilla for profit or reward or is employed in Anguilla for
wage, salary or remuneration contrary to the provisions of
this section, and any person who knowingly employs in
Anguilla any such person, is guilty of an offence and is
liable on summary of conviction to a fine of EC$2,500.00 or
to imprisonment for a term of 6 months, and in the case of a
continuing offence, to a further fine of EC$250.00 for each
day during which such offence continues.”
The Immigration, Labour and Police Task Force will be
monitoring these situations closely. The Ministry and
Department of Labour will be enforcing the Control of
Employment Act and are appealing to persons to adhere to
such.
